Вручити таку повістку можуть не лише працівники центрів комплектування, тобто військкоматів, але й поліцейські, роботодавці чи працівники органів місцевого самоврядування.

Закон про загальну мобілізацію підписав президент України 25 лютого 2022. Водночас у березні з’явилися непоодинокі випадки вручення повісток на блокпостах, просто на вулицях, у магазинах та квартирах, пише my.rv.ua.
Ми поцікавилися в адвоката Ігоря Волошина про те, які є юридичні аспекти вручення повісток.
Повістка має бути підписана керівником територіального центру комплектування, до якого приписана конкретна людина. Вона має бути виписана на конкретну особу до моменту підпису.
Тобто випадки, коли штампують пачки порожніх повісток, а тоді приходять в готелі, квартири чи на просто на вулиці і вручають людям – це незаконно.
При врученні повістки вас не мають права насильно доставляти до ТЦК. Вам можуть запропонувати сісти в автобус та проїхати з ними, але ви маєте право відмовитись та повідомити, що прийдете добровільно у визначений час. Якщо вас силою намагаються забрати та доставити у військомат – це злочин, за який передбачена кримінальна відповідальність (стаття 146 Кримінального кодексу). Ви або ваші близькі повинні фіксувати це на відео, після чого дзвонити у поліцію та адвокату.
Якщо вам вручають «Порожню» повістку, це можна і треба оскаржувати. Звертатися зі скаргою можна у свій військкомат, міністерство оборони або Національну поліцію.
