Az Alkotmánybíróság három bírájának, Viktor Krivenkónak, Volodimir Mojsziknak és Viktor Kolisznyiknak hétfőn lejárt a 9 éves mandátuma, ami gondokat okozhat Ukrajnában – közölte Dmitro Lubinec, a Legfelső Tanács emberjogi biztosának Telegram-csatornáján, számolt be az rbc.ua hírportál.
A jelentés szerint az Alkotmánybíróság sajtószolgálata beszámolt arról, hogy ma volt az Alkotmánybíróság rendkívüli ülése, amelyen három bíró felmentésének ügyét tárgyalták a kilenc éves hivatali idejük letelte miatti lemondásuk alapján. „Az Alkotmánybíróság az említett kérelmeket kielégítette, és határozatot hozott Kolisznyik, Krivenko és Mojszik 2025. január 27-i felmentéséről” – áll a közleményben.
Az ombudsman szerint az Alkotmánybíróság határozatképességének elvesztése veszélyezteti Ukrajna jogrendjét. „Rész vettem Ukrajna Alkotmánybíróságának ünnepélyes ülésén, amely három bíró, Viktor Vasziljovics Krivenko, Volodimir Romanovics Mojszik és Viktor Pavlovics Kolisznyik hivatali ideje lejártának szenteltek” – írta Lubinec.
Az ombudsman szerint három bíró jogkörének egyidejű megszűnése a bírósági nagykamara, valamint a bíróság második szenátusa üléseinek megtartásához szükséges határozatképesség elvesztéséhez vezet. Mint megjegyezte, egy ilyen helyzet elfogadhatatlan, mert a jogrend stabilitása, valamint minden állampolgár jogai és szabadságjogai védelmének garantálása az Alkotmánybíróság munkájától függ.
„Felszólítok minden illetéket, hogy biztosítsa az Alkotmánybíróság bírái kiválasztásának és kinevezésének hatékonyságát, mert ezen múlik államunk alkotmányos berendezkedésének stabilitása” – mutatott rá Dmitro Lubinec.

Joe Biden, az USA elnöke, az alkotmánybíróság szerepét betöltő legfelsőbb bíróság megreformálására készül.
Egy bizottság foglalkozik majd a különféle reformjavaslatokkal, valamint azok megvalósíthatóságával és szükségességével. Egyebek között vizsgálni fogja, hogy hány tagja legyen a legfelsőbb bíróságnak, és hány évre nevezzék ki őket.
A jogprofesszorokból, ügyvédekből és egykori bírákból álló bizottság tagjainak az első ülést követően fél évük van arra, hogy összeállítsák jelentésüket.
A legfelsőbb bíróság az Egyesült Államok legfelső szintű fellebbviteli bírósága, amely egyben az alkotmánybírósági funkciót is ellátja, székhelye Washingtonban van.
A grémium jelenleg kilenc tagból áll, akiket az elnök nevez ki, de tisztségüket csak a szenátus jóváhagyásával foglalhatják el. A bírák élethosszig viselik tisztségüket, csak kongresszusi eljárás keretében mozdíthatók el, és csak akkor, ha bűncselekményt követtek el.
A bírák kiválasztása politikai jelentőségű folyamat. Donald Trump előző elnök alatt három új bírát neveztek ki, így a kilencből hat bíró konzervatívnak számít. Trump a liberális Ruth Bader Ginsburg tavaly szeptemberi halálát követően mindent megtett, hogy még a novemberi elnökválasztás előtt kinevezze a megüresedett helyre saját emberét a konzervatív Amy Coney Barrett személyében.
A demokraták választási kampányában szerepelt a legfelsőbb bíróság reformja. Szó esett egyebek között a testület kibővítéséről és a bírák hivatali idejének korlátozásáról. Vezető republikánus törvényhozók határozottan elutasítják a tervezett változtatásokat.
