A bolgár alkotmányban szereplő „nem” szó kizárólag a biológiai nemet jelenti, nem lehet társadalmi nemként, azaz genderként érteni, erről döntött a bolgár alkotmánybíróság az Euractiv szerint.
A bolgár legfelsőbb bíróság idén márciusban kérte fel a bolgár alkotmánybíróságot arra, hogy értelmezze a biológiai/társadalmi nem fogalmát. Erre a legfelsőbb bíróság szerint azért volt szükség, mert a bolgár bíróságok gyakorlata nem volt egységes a tekintetben, hogy az alkotmányban szereplő „nem”-et társadalmi vagy biológiai nemként értelmezték akkor, amikor transznemű emberek eseténben döntöttek a személyiigazolványukban szereplő nem megváltoztatásáról.
Az alkotmánybíróság most azt állapította meg, hogy a bolgár alkotmány nem ismer a biológiai nemtől független társadalmi nemet. Kimondták emellett azt is, hogy a bolgár alkotmányban a „nő” mint biológiai nemi kategória az anya társadalmi szerepével, a gyermekszüléssel és a szülészeti ellátással függ össze.
A döntés értelmében a bolgár intézmények nem kötelezhetők arra, hogy elfogadják azt, ha valaki a születéskor regisztrált biológiai nemétől eltérő módon azonosítja magát. Az alkotmánybíróság szerint a transznemű emberek jogi státusza a csak a jogszabályok módosításával lenne megoldható.
Bulgáriában a biológiai nem/társadalmi nem fogalma körüli jogértelmezési vita három éve kezdett elmérgesedni, amikor a Polgárok Bulgária Európai Fejlődéséért (GERB) nevű jobboldali párt elutasította azt az előterjesztést, amivel a családon belüli erőszak visszaszorítását célzó isztambuli egyezményt ratifikálta volna az ország, részben arra hivatkozva, hogy az egyezmény használja a gender, azaz a társadalmi nem fogalmát. A GERB 2018-ban kampányt indított, amelyben hamisan azt állította, hogy az egyezmény lehetővé tenné az azonos neműek házasságát és bevezetné a harmadik nemet.

Az amerikai külügyminiszter tájékoztatása szerint első lépésként – lényegében „bemondásra” – választhatóvá tennék, hogy valaki a „férfi” vagy „nő” meghatározást szeretné látni a dokumentumban. Eddig ugyanis orvosi igazoláshoz volt kötve, ha valaki másmilyen nemet szeretett volna feltüntetni, mint az a születési anyakönyvi kivonatában szerepel.

Ezenkívül minél előbb, sajtóértesülések szerint akár már év végéig bevezetnék azt is, hogy a nem-bináris, az interszex és a nem-gendernkonform emberek a semlegességet jelölő X-et írják be az okmányukba az M (male, férfi) és az F (female, nő) helyett.
– Remek hír az összes interszex és nem-bináris embernek, mert ez lényegében azt jelenti, hogy lehet útlevelünk. Nem kell hazudnunk azért, hogy megkapjuk az útlevelünket. Csak önmagunk lehetünk! – kommentálta a hírt Dana Zzyym, a tengerész veterán, aki elsőként igényelt nem-bináris útlevelet, és korábban perre ment a külügyminisztériummal az ügyben.
A lépés jól illeszkedik Joe Biden demokrata amerikai elnök politikájába, aki nemrégiben Jessica Stern személyében egy LMBTQ-különmegbízottat is kinevezett, akinek feladata, hogy az amerikai diplomácia és segélypolitika világszerte támogassa és védelmezze a leszbikus, meleg, biszexuális, transznemű közösség tagjainak jogait. Nem sokkal korábban pedig arról döntöttek, hogy az egészségügyi biztosítás fizeti a transznemű veteránok esetleges nemátalakító műtéteinek költségeit. Egyes becslések szerint egyébként összesen akár 134 ezer transzgender veterán is élhet az Egyesült Államokban, miközben 15 ezren jelenleg is a hadseregben szolgálnak, bár a védelmi minisztérium belső vizsgálatai ennél alacsonyabb számokról szólnak.
De az elnök kormányában is helyet kapott egy transznemű, Rachel Levine egészségügyi miniszter-helyettes lett, aki fontos területért, a koronavírus-járvány elleni küzdelemért felelős.
Mint arra a nemzetközi sajtó is emlékeztet, a világ több országában, így például Ausztráliában, Kanadában, Németországban, Új-Zélandon, sőt Indiában és Nepálban is van lehetőség harmadik nemet megadni a dokumentumokban. Az Egyesült Államok néhány államában más dokumentumokban, például a személyi igazolványban vagy a jogosítványban már eddig is elérhető volt az opció.
